I got sued by Apple.
So, Apple is now officially suing me for not taking down that credit card video. They served me with a cease and desist letter about 48 hours after I posted that video. I hired an attorney who claimed that this video was fair use. We responded back, and then they served me with a lawsuit.
My attorney told me not to make this video, but I feel like the more attention it gets, and maybe if it goes viral or something, that maybe things can change because I do not want to get sued by Apple. This is not okay. I have no idea if I’m gonna have to take down this video too, so if there’s a small chance this might be gone, in which case if my attorney tells me yeah, I will need to do that. I will, you know, I will listen to that.
But as many of you know, I made an Apple credit card video just a few days ago. In that video, I used some of Apple’s footage. My video was fair use because it was commenting on it. I basically went over the features of the credit card. I discussed my assumptions about why I thought they were doing that, and I just gave my own reasoning for why I wasn’t personally getting the credit card. I wasn’t saying that this is a terrible credit card for everyone; I just explained why I wasn’t personally getting this card.
Yes, I realized I made a few stupid jokes in that video regarding Goldman Sachs and their previous history with mortgages. That was meant to be more of a satirical thing; I’m not doing this seriously. I’m just having fun with it, and I thought people might enjoy just a weird, stupid sense of humor.
You could look back at this because even in that video, I straight-up said I would recommend it, and my answer was yes because it’s a decent card. It’s just not that good of a credit card; that’s what I said. They can’t hit me with defamation because of that because that’s a fact, and there are straight-up other better credit cards. That’s not subjective; this is something that’s fact. They can’t claim I’m trying to damage their company because of that.
But anyway, what I’m getting at here is that I didn’t realize that video was going to do as well as it did and get as many views as it did. Within the first 24 hours of posting it, it was at a hundred thousand views. I was blown away, and I guess it got pushed. That’s the reason they wanted me to basically take the video down.
Then, I want to say about a day and a half after I posted that video, I posted on Tuesday, so this would be Wednesday night. An attorney from Apple reached out to me. I’m not going to read the entire email, but basically, they said that my video consists of false statements intended to cause harm or damage to Apple Incorporated. Then they go on to say, “You are hereby requested to immediately cease and desist the illegal defamation and/or libel within 24 hours.”
I don’t know what they’re calling illegal defamation because that was my opinion; that it was not that good of a credit card. I don’t know. But then they say failure to comply with this cease and desist request within the stipulated time frame will leave no other alternative but to pursue all available legal remedies, including filing a motion for injunction relief, monetary damages, filing fees, court costs, and/or attorney’s fees.
As soon as I got that, I contacted a local attorney who told me not to worry. Apparently, this is a common thing that many companies will just issue cease and desist letters to try to get videos down. They do this because it just scares most people. But the attorney told me my video falls under fair use, and it was just opinion. This is basically a version of free speech, and that I should not worry. Basically, I was being bullied by a larger company to try to scare me into taking the video down. He told me I would be fine and just keep the video up.
I was definitely really nervous about that email that I got, but I also kind of thought, “It’s Apple! They’re such a big company. They get tens of millions of views. Why would they care about me? Why would they waste their time with me for a few hundred thousand views?” I thought it was more of just a scare tactic.
Then, 24 hours later, they served me with a lawsuit that is basically for defamation towards Apple. I spoke with my attorney and said, “Can I just take the video down now and make this all go away?” Because this has already been filed, it’s a little too late for that. So, I’m basically at this point at the mercy of them.
I had no idea how much this is going to cost me. I guess we’re gonna try to settle again. I had no idea how long this process can take or what this is going to be like. I’m speechless, and the thing that really sucks the most about that video is that it was really just my opinion. I said that it was a decent card, but it’s just not that good of a credit card.
I said that they should offer a signup bonus, which would incentivize people to go and get the card. Every other credit card out there has a signup bonus, and it works. That’s what it would take for me to get the credit card. I didn’t say that everyone needs a signup bonus. I said if you just give us something—even if it’s just like a hundred dollars off an iPhone—give us something! Or even just give us a free pair of Apple AirPods because that would be nice.
Honestly, it’s my opinion. This is not facts; this is not defamation. I think getting 1% cash back on all other purchases outside of Apple Pay is too low, considering that Fidelity and Citi both offer 2% cash back cards on everything. If they just did that, I would have gotten the credit card.
I also said it was just my opinion that they’re targeting Millennials who just want a metal credit card, so they made it titanium. Like I even said in that video, and I will play it right here as proof that I would recommend the credit card. It’s just not for me. So, I don’t get what I said that is so bad, so damaging to them that they’re so upset with. I just don’t understand it because I actually like Apple. I’ve had an iPhone for years now. I have AirPods; I have two MacBook computers. Apple is such an amazing company that they can actually get away with charging $1,500 for a phone that doesn’t have a headphone jack in it.
Apple even invented the AirPods; these didn’t even exist before Apple. Apple has done so many revolutionary things. They invented iMessage; they invented the iPad. They got rid of the headphone jack on the iPhone. They got rid of all of the useful ports on the MacBook Pro and exchanged it for a dongle. And they nearly revolutionized the credit card.
Also, they’re doing all of this with our safety in mind because their phones don’t blow up like Samsung’s do. Apple is the only company out there that will make fewer and fewer changes each and every year and charge just more and more money, and we pay it just because we love Apple. They can obviously tell that I am a big fan of Apple, and there are so many people that made similar videos to mine on the Apple credit card, and those videos are fine. But they go after mine for some reason because I think it just got a little bit more traction for some reason.
So anyway, my lawyer told me that in order for them to actually win this case and get the whole thing held on, one second—oh, that’s my avocado toast! One sec! Oh, I love this! So anyway, like I was saying, in order for Apple to actually win this case, they have to prove that damages were actually done, which there is no way they can do. I think I’m more worried about Apple just dragging this out as long as they can because they are a big corporation with unlimited resources, and they can drain a lot of money from me just to, I guess, prove a point.
Basically, just to say that a big, scary corporation like Apple can go and bully someone who might not have the resources to fight for what’s right. I’ve noticed that when it comes to a lot of these court cases, it really just comes down to who has the most amount of money, and that is just what the legal system is, I guess.
Oh, crap! My lawyer's calling me right now—one second! Yeah? Alright, that’s great! You know I’m recording a video right now, so, okay, let me tell them. The hallway—so my lawyer is telling me right now that Apple is actually willing to drop this case entirely if this video gets 20 likes!
Okay, so yeah! If we can get this video to 20 likes, Apple will drop this court case! So make sure to hit the like button because—oh! This is an April Fool’s joke! No, Apple is not suing me; this is just an elaborate April Fool’s prank! I guess I got you!
